1. You can use DBFree libraries and MaxScript freely, on any computer, for staging and for production use, including workstations, virtual machine and web server in a commercial organization.

2. You do not need to register or pay for libraries accompanying the DBFree original distribution and for the MaxScript interpreter.

3. You can sell or market the applications you made with or for DBFree and MaxScript, as long as you clearly state in your code and/or the product and its license that in no way or matter shall Maxsis and DBFree.org will be responsible for any defect or malfunctioning or elsewhere damage the product and its component may ever cause.

4. DBFree libraries, MaxScript (MAX Command Processor) code samples and the accompanying utilities are distributed in the hope that they will be useful, but WITHOUT ANY WARRANTY; without even the implied warranty of  MERCHANTABILITY or FITNESS FOR A ANY PARTICULAR PURPOSE.

5. In all documentation and whenever possible in your final products the name MaxScript (if cited) should always be written in a single word with "M" and "S" uppercase, the rest lowercase.

DBFREE STANDARD LICENSE
This license must be included into your final application

A) - DEFINITIONS

1. "Package" means the full set of the original distribution of software components and documentation that constitute the product named "DBFree" in its current versions and provided to you as a whole, aside its associated media, printed materials, online or electronic documentation, and any updates and maintenance releases thereto.
2. "Core engine" means software products that are licensed to you under this license, usually referred as “MaxScript”, but not limited to, and any related components provided with the "package", and its application programming interfaces,.
3. “Producer” means the producer of the "package", that is “MAXSIS - FIRENZE - ITALY”
4. "Guest Operating Systems" means instances of third-party operating systems licensed by you and installed on a personal computer, a server or on a Virtual Machine and that runs the "core engine" and its "Redistributable Components".
5. "Redistributable Components" means any software library that may be provided in conjunction with the "core engine" including the HTML/MaxScript source code, the accompanying web sites and all the documentation referring to them.
6. "Sample Programs" means source code, scripts, web applications or web sites that may be distributed with the "package" or downloaded from the site of the producer.
7. "Software License Key" means, if applicable, a serial number issued to you by the producer to activate and use the "core engine" on a specific web site, by means of registration mechanism provided by the "producer
8. "interpreter" is the software engine named "MAXcp" or "MAX Command processor" or "MSPserver"
9. "Production server" means any machine running the package and exposed to internet, or to a local area network.
10. "product" is the software you will realize and that will make use, esclusively or partially, of the "core engine".
    

1. This document states the terms of the license for the "package" distributed under the name "DBFree" or "DBFre standard edition" or "DBFree-DEV Developer Edition"
2. The "core engine" is always licensed, not sold.
3. Subject to the terms of this license, the "producer" hereby grants you a non-exclusive, non-transferable license, without rights to sublicense, to use the "core engine" and its "Redistributable components"  for building your own "product", for personal or commercial use.
4. You're granted all the rights, including renting, sublicensing or selling, on your "product" without paying anything to the "producer".
5. You can not modify, disassemble or change the "core engine", the "package" and all the "Redistributable Components" except those provided as source code, change the logos and trademarks or delete credits to "producer" if present.
6. Upon the terms of this license you can freely distribute your "product" and  apply your own license terms and conditions including charging fees paid to you or to your subsidiaries for the use of the "core engine" and all "Redistributable Components".
7. You can freely re-distribute all the documentation accompanying the "package" in connection with permitted uses of the "core engine" but you may not remove any titles, trademarks or trade names, copyright notices, legends, or other proprietary markings on the documentation and "redistributable components".You are not granted any rights to any trademarks or service marks of MAXSIS.
8. The producer retains all rights not expressly granted to you: by using the "package" for your "product" you agree to indemnify, hold harmless, and defend the producer from and against any claims or lawsuits, including attorneys' fees, that arise or result from the use or distribution of the "product" or any other software solutions you create thast will be using the "core engine" or th "package".
9. This license must be included intact in the "product".

C) - LIMITATIONS

1. You may copy the "core engine" on any number of workstatios, servers or virtual machines at your will.
2. You may distribute the "product" outside your entity provided that you do not modify the core engine, proprietary markings, trademarks or service marks of MAXSIS, you do not use MAXSIS's name, logo or trademarks to market the "product".
3. Notwithstanding the foregoing, you may refer to "package", MAXSIS names, logos or trademarks to indicate that the "product" or any software solution you create with the "package" are designed or made for use with the "core engine" or the "package".
4. The "product" may include "Sample Programs". You may use and distribute "Sample Programs" under the terms of this license and state clearly in your "product" that the "producer" does not provide support services for "Sample Programs".
5. The "producer" retains all rights, title, and interest in and to the "package" and in all related copyrights, trade secrets, patents, trademarks, and any other intellectual and industrial property and proprietary rights, including registrations, applications, renewals, and extensions of such rights
6. The "producer" will not provide any support services under this license. This license does not give you any rights to any updates or upgrades to the "package" or to any extensions or enhancements to the "core engine" developed by the producer at any time in the future. The "producer" releases upgrades on a occasional basis only by means of it web site. Is up to you to provide the update of your "product".
7.  MAXSIS may offer support and subscription services separately. If you have purchased MAXSIS professional products (as DBMAx or similar) these services are provided to you under the Support Contract Terms and Conditions specific of your version.
    
8. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, MAXSIS PROVIDES THE SOFTWARE WITHOUT ANY WARRANTIES OF ANY KIND, EXPRESS, IMPLIED, STATUTORY, OR IN ANY OTHER PROVISION OF THIS LICENSE OR COMMUNICATION WITH YOU, AND MAXSIS SPECIFICALLY DISCLAIMS ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON- INFRINGEMENT.
    

9. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL THE PRODUCER BE LIABLE FOR ANY LOST PROFITS OR BUSINESS OPPORTUNITIES, LOSS OF USE, BUSINESS INTERRUPTION, LOSS OF DATA, OR ANY OTHER INDIRECT, SPECIAL, INCIDENTAL, OR CONSEQUENTIAL DAMAGES UNDER ANY THEORY OF LIABILITY, WHETHER BASED IN CONTRACT, TORT, NEGLIGENCE, PRODUCT LIABILITY, OR OTHERWISE. BECAUSE SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF LIABILITY FOR CONSEQUENTIAL OR INCIDENTAL DAMAGES, THE PRECEDING LIMITATION MAY NOT APPLY TO YOU.
   MAXSIS LIABILITY UNDER THIS LICENSE WILL NOT, IN ANY EVENT, EXCEED THE LICENSE FEES, IF ANY, PAID BY YOU FOR THE SOFTWARE LICENSED TO YOU UNDER THIS LICENSE. THE FOREGOING LIMITATIONS SHALL APPLY TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, REGARDLESS OF WHETHER THE PRODUCER HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES AND REGARDLESS OF WHETHER ANY REMEDY FAILS OF ITS ESSENTIAL PURPOSE.
    

10. This Agreement sets forth MAXSIS's entire liability and your exclusive remedy with respect to the "package" and supersedes the terms of any purchase orders and any other communications or advertising with respect to the "package".
    You acknowledge that this Agreement is a complete statement of the agreement between you and the "producer" with respect to the "package", and that there are no other prior or contemporaneous understandings, promises, representations, or descriptions with respect to the "package".
